Adjustment of Status Filing Charts from the Visa Bulletin

The U.S. Citizen and Immigration Service (“USCIS”) has recently announced that in November, 2015 the Department of State (“DOS”) Visa Bulletin (“Visa Bulletin”) will issue a determination within approximately one (1) week following the publication of the Visa Bulletin as to whether individuals may use the chart titled- Dates for Filing Visa Applications. If USCIS determines that there are more immigrant visas available for a fiscal year than there are known applicants for such visas, USCIS will indicate that the person may use the Dates for Filing Visa Applications chart. However unless otherwise stated on the USCIS website, individuals filing an adjustment of status application are advised to continue to refer to the chart titled the Application to Final Action Date if the USCIS does not post a determination.

The DOS publishes the Visa Bulletin on a monthly basis and states when statutorily limited visas are available to prospective immigrants based on their individual priority date.
