- Second offense DUI: Punishable by up to nine months in jail, and up to 12 months in jail if your BAC was .15 or higher, or a child was in the car; if the conviction is the second within five years, the driver must serve 10 days behind bars, 48 hours of which must be consecutive; fines range from $1,000 to $2,000, and $2,000 to $4,000 if aggravating factors are present
